No. You've added a variable that alters the crime, not the consequence of the crime. Further, you've added to the list of crimes committed.

Armed robbery is armed robbery regardless of the means of armament used to threaten. The armament used to threaten can also be a seperate crime (possession of nuclear weapon for instance).

However, if the weapon were used the crime changes again. If you shoot to kill 9 people using your handgun, that is 9 counts of attempted murder and will be tried as such. If you shoot to kill 30 people using your machine gun, that is 30 counts of attempted murder and will be tried as such.

I am arguing to upgrade the current "lesser" crimes to the more "serious" version. For instance, attempted murder should be upgraded to the same punishments as for murder.

At the moment, attempted murder = 15ish years, murder = 25ish years. In my system, attempted murder = 25 years and murder = 25 years. They would no longer be seperate crimes.

Not quite sure how catching criminals comes into a discussion about how they are tried, convicted and sentenced since it is already presupposed that they have been caught. It's fairly obvious that you have to catch a criminal before they can be tried, convicted and sentenced.
