I missed the summary....

I am NOT saying that the APPALLING drivers in both the hypothetical example and the REAL eaxmple should NOT be punished..... they SHOULD..... but the 'thing' for which they should be punsished is NOT the 'result' of their bad driving because the 'result' was NOT under their control. Their DRIVING was under their control..... or SHOULD have been!

The ONLY common-sense version of this would be to punish drivers for bad DRIVING.... regardless of bus-driver's alarm clocks and late-constructed Armco barriers!

Punishment is SUPPOSED to be for something you DO that's wrong. The 'wrong' thing was falling asleep/losing control of the car. THAT's what SHOULD be punished! But it ISN'T!
