The old ABS systems that relied on ratchets did fail - one failed on me in an 1990 Escort when I was working for Ford in 1991.

The driver pursued by the cops may have an option to contend the failure of his limiter, but the same could happen today if a driver's throttle got stuck or the ECU failed to process the potentiometer's instruction to reduce the speed.

Yes there are issues with litigation here but having worked in the car industry Ian [as I have], you know that its wall to wall with litigation and all major manufacturers have teams of lawyers to deal with these situations.
