Honda Cadet carb legality

One of my engines has a pilot screw (ally) that can only turn 1/4 turn (and cannot be removed) and the other engine has a "traditional" pilot screw (brass) that is fully adjustable.

I assume the first type is the original so, as the regs state that only un-modified carbs can be used, is the second carb (ie brass idle screw) illegal ?

Also, the GX160parts website states that either a #35 or a #38 pilot jet can be used - are they both legal as nothing is mentioned in the regs about alternate pilot jets.
