It is not up to an engine builder in a non-sealed category to only build engines that are legal for MSA racing. MSA racing isnt the only way to go karting. A TKM engine tuned the nuts out of would be great to run at practice days, or in a RWYB class at non MSA meetings.

The responsibility belongs to the entrant to use legal engines only in competition. The illegality here is with the driver who requested the work and then used the engine at a meeting. If the engine was purchased from someone who had commisioned this work, then more fool them for not having it checked for legality first
