The person in front only owns the track if someone else is not attempting to overtake.

The person is front is allowed no blocking manoeuvres, he is allowed one defensive manoeuvre which is an entirely different thing. That manoeuvre must be started before the other kart starts an overtaking move, otherwise it becomes a 'move to hinder' and illegal.

If a person with another kart alongside attempts to drive the other kart off the track, then he is in the wrong, whether or not he has a slight lead.

You are quite right, it is a no-contact sport. And also right that one needs to use some common sense

The difficulty is that various CoC's interpret the rules in their own way. Some will say one thing and some the other. For reference, at Dunks last month someone asked whether one was allowed to steer across at someone alongside, to push them to the edge of the track as a 'defensive' manoeuvre, The COC stated that was not allowed and the MSA Steward seemed to agree with him.
