rotax gear oil overflow

I have just had my lads minmax rebuilt. First time started noticed what looked to be oil/air coming up the overflow pipe. Didn't think anymore of it. I noticed oil draining from the catch tank once chassis stood up (no engine fitted) The engine has approx 2 hours on it now. I have drained the oil and there is just over 100ml. The oil looks a little dirty.
Is this a case of my engine builder just putting a little too much oil in or is it a little more serious (seal or gasket leaking).
