Simon in the karting magazine (feb 2010 issue) there is the second part of an article by Iain Blair called "A rough guide to the MSa judicial procedures".
One section says "at this juncture it is normal to tell the driver that he or she isn't considered to be cheating, especially if just half a kilo underweight, but that the kart doesn't comply with the technical regs. it should also be said that the imposition of an exclusion or any other penalty won't be recorded on your licence for a technical offence and you won't get any points either."
Iain also points out that technical and sporting regulations need to be written to ensure that justice can be seen to be done without overly penalising minor errors.
Taking the case of my lad crossing the start line in 1st place instead of 4th it could well be that the Coc took the view that for a relatively inexperienced driver to move forward when the 2nd place man goes off and then accelerates a bit too quickly comes under the minor error whereas perhaps at a FKS/S1 meeting for the 8th spot to cross the line in P1 would be considered more seriously.
Apart from being polite to CoC I think it can also help just to be honest - "I totally messed up my breaking point and took Joe off" may help to get CoC searching for the non-points penalty just from the joy of not having to sit through 20 minutes of `he did this - he did that'.
