If they stated it as a 2009 MSA approved helmet then they cannot be held responsible for what happens afterwards.

You can't expect the retailer to foot the bill for this one, as has been said they don't make bucket loads of money as it is so something like this would kill the business if they were to refund everybody.

The distance selling regulations give you all the info you need regardihg buying over the internet but the retailer has not done anything wrong. If they had put suitable for 2009 onwards then you might have a case.
