"Drop down" bumper penalty at S1

During the mini race a competitor lost his nosecone through no fault of is own (Think on the last lap) no penalty was issued as they argued it was not his fault. I agree with this...but why don't they apply this rule when the nose cone has moved???? trying to figure out what the difference is between a moved nosecone and a lost one in penalties....
