It seems to be that one reason behind some examples of poor driving is that the current MSA regulations have an imbalance.

Marshals do the best job they can, but can only be expected to report a percentage of the incidents, which leaves a further percentage unreported.

Drivers can therefore play a "percentage" game and then hope that the worst that they get is a 5 place penalty.

For the victims, though, it's far worse.

They have no incentive whatsoever to protest if the marshals haven't reported something. Their finishing position (if they finished) is unchanged and they carry the cost of repairs caused by someone else.

The regulations themselves therefore serve to promote poor driving and ultimately it is the victims who are left to carry the cost in all respects.

If the regulations made provisions such as the ones I'll outline below, then (i) victims would have an incentive to protest to ensure that incidents missed by marshals were dealt with justly; and (ii) poor driving would be discouraged (so incidents should reduce).

Ideas for new regulations, where a driver is held to be guilty:

1. Allow the Clerk of the Course to reverse the positions of the penalised driver and the victim (even if the victim didn't finish the race)

2. Provided damaged karts return via scrutineering, the penalised driver (or entrant for minors) becomes responsible for the costs of any repairs identified by Scrutineers in the victim's kart and mandatory equipment.

More paperwork? Probably

Fewer Incidents of poor driving? Certainly

Probably a bit controversial, but if decent drivers are being discouraged by the current imbalance, then it will go some way to explaining the continuing decline in driver numbers.

Is this something that the clubs could discuss and raise at ABkC?
