The Rules are there for a reason whether we like it or not we agree to them and race under msa rules if we feel we do not like or agree to them. The option is to race at the many circuits around the country that do not run under msa rules and may if you are lucky allow you to race although all of these circuits run their own rules with different standards.
The driver in question should not have got through scrutiny if the kart is not up to current rules and regs.One of the failing of MSA is that around the tracks that scrutineering standards differ. How much support or training from MSA do our scrutineers get in a year? At local level the clubs are all trying to encourage new blood into the sport and it is understandable why the scrutineer in question allowed this kart to race, and if the driver came last i dont think we would be talking about it on here today. Personally i think that as the kart in question was passed to race. And nothing has changed re the kart since it went through scrutiny then the result should stand. and the club in question should have a debate themselves over the position of what rules they are going to enforce and let everyone know where they stand.
