You state that the 'named person' could NOT sue by being named.

Just READ the reply which follows YOUR! You'll note that Graham makes that link INSTANTLY! He claims that it is 'protect other buyers'.

Err..... exactly HOW would it protect them if YOU were right???? By definition, the ONLY way that naming the person COULD protect others is if they ASSUMED that the named person WAS the one selling 'cheated' equipment otherwise and that they would AVOID buying sdtuff from the named person.! In what OTHER way could it 'protect other buyers'????

A court would find it PERFECTLY accaptable that Hulacki DSHOULD be able to work out that SOMEbody would think like Grahamrich and thsu PUBLISHING his name could WELL give rise to EXPECTED damages!

I tell you what: if you are SO sure you are right, ask Hulacki to tell ONLY you and then YOU publish the name! Of course, you could always offer to indemnify Hulacki and pay ANY 'damages' he suffers by publishing the name.........
