Actually Chris, the answer to your conundrum:

You get my point? I'm sure you do! Eliminate the pedestrian from the path of the driver and all you're left with is: "scuffs and dents to the cars"! OK, I'm exaggerating it a bit but you get my gist! Metal and flesh don't mix so eliminate the flesh, educate and make it safe for it to cross and you're left to deal with the metal!

And just because we don't have LAWS to stop the pedestrian wandering into the road whenever and wherever he/she wants is the reason the driver HAS to learn and obey HAZARD AWARENESS! The penalty for not doing so is 100% at fault in a collision with a pedestrian, regardless!
