Assuming the Rotax example to be the c.....o allegation, the mod. carried out was quite clever imo but no doubt the financial outlay was considerable and the engine performance was improved. The same effect could have been either provided by the manufacturer or carried out by owners for 'free' if allowed by the rules. The same situation exists in Honda where over restrictive rules in many areas stop people doing the 'free 'mod , allowing engine builders to charge a bomb for engines using out of normal tolerance parts which are deemed legal because they are original unmodified Honda. These are then sold on to people who wouldn't know ' a big end from a bicycle pump ' but have more money than enough. Not only is this unfair, in a claimed budget engine class, and a distortion of the rules, but prevents young competitors from acquiring the practical knowledge of engines which should be a part of the karting experience.
