It is not that simple Alfie as the damage could have been caused by hitting high kerbs or in a crash either with another kart or into a tyre barrier. Look at the outcry earlier this year when it looked as if chassis protectors would be banned. Cries from tonykart owners that their chassis would be runined after a couple of races - but chassis protectors are not fitted as standard!
There appears to be a case for claiming a manufacturing fault but what percentage of karts sold are having this cracking problem? Does it only happen when a TKM engine is fitted.
Paul is quite right to try and gather this information to try and prove there is a basic fault.
