It seems to me that rather than address poor driving standards at source, the CIK (and subsequently the MSA) have decided for the copout route, where bringing these in with a fixed rule that cannot be appealed means the officials dont have to make the difficult decisions anymore.
The far better solution would be thus: Appoint one / two additional stewards to work alongside the Clerk of the Course. These officials, on site of deliberate, avoidable contact (and there would have to be a cast-iron definition of what this entails) report back to the Clerk. The offending driver is docked 5 positions for first offence. Second offence is 10 positions. Third offence is race disqualification. If the driver in a later race commits a fourth offence, they go home.
Its as simple as that! Start hitting drivers where it hurts, the pocket and the track time. If drivers start getting disqualified and sent home for deliberate contact, it will stop it. And, rather than starting in Junior / Seniors, it needs to start in Cadets! Stamp the problem out early and it doesnt progress into the upper age groups.
As for your point about will it kill MSA karting, not entirely. There will always be a hardcore that will continue regardless. That said, if this becomes a problem countrywide, watch grids shrink. When you look at the number of circuis offering IKR nowadays, the MSA should be worried
