The mere fact that the X2 transponder does transmit data renders it illegal for use under the current regs regardless of the claim that the data is not used.
If someone does use the X2 then I would not like to be the competitor going to scruitineering post race and expecting to be included in the results. The clerk and stewards would have no choice to exclude for a non compliance.
Naturally I am assuming that the X2 transponder does, as I said in my original post, transmit data. It is also correct that a more powerful signal will not offer a timing advantage by virtue of the system operation but the fact remains that there are approved systems in place. If it is now confirmed that new 160 replacements are no longer available then that will become a problem in the future, however there are way more 160 type transponders out there than competitors so don't expect an immediate change in the regulations.
