99 times out of a 100 people do get away with stuff like that. Unfortunately when it does go wrong it's often someone doing nothing wrong that's taken out by someone out of control. If a kid hasn't got the skill to run near the front with a stock engine what's the point tuning their engine to put them there. The trouble is once one does it others feel they have to follow, I know most non-MSA track do largely run with some engine controls but I've even see it at regular owner-driver practices kids with tuned gx200 engined cadet's. If it's no harm it's strange how those same kids are the ones who often gain the reputation for caursing accidents. As for tuned bambino's, a six year old in a 50mph+ kart amongst 30mph gx35 powered first-timers can never be a safe mix!
