The design appears to allow the following kart to lift the rear end of the kart in front so yes there is contact. As cadets do push each other there will always be some contact and most of it should be treated for what it is - a racing incident. You will never eliminate contact - if you could I reckon a lot of F1 teams would be looking for advice on that.
The main issue seems to be that when a Zip spins and ends up facing the rest of the field the nose cone can act as a ramp and make any contact worse.
The difficulty for the MSA is proving that it is the nose cone that causes the problem as karts do flip when wheel contact happens.
It just seems that over the last few months there have been several cases of flipping where a Zip has ended up facing the wrong way and the drivers have been injured and this obviously focuses everyones minds.
The issue of using the nose cone for advantage is probably a bit of a red herring - it may be an advantage if you want to drive `dirty' but I would bet that most drivers don't use it that way but there will always be the odd few who do.
