you cannot really compare the cc size rule and the kerb rule!
to have an engine outside the cc rule would require total intent to break the rule before entering the circuit for a competition while going over the kerb might be quite subjective (example of the tennis ball over the white line) and might have happened, "maybe" just for one lap? for 2? might have been accidental?

As you say it is not enforced! so the rule book says one thing quite clearly while the jurisprudence by the officials on the day is quite vague by the lack of actions on their part!
Talking about Hamilton is a good point!
My point would be that not everything is black and white...sometimes it is grey!:)
