(1) could not possibly be enforced fairly. Imagine an incident early in the race where a "top" driver fires off a regular "backmarker" and goes through to win the heat. Would you reverse the positions in this case (even though said backmarker would never normally win a heat).

(2) is doable, though I'm not sure I would support it. If the risk of getting caught is already low, I don't think this would have much effect. Moreover, most "foul play" ends without kart damage; granted, people are most upset when both their race and their kart has been ruined.
