I have recently modified a Tonykart Mytox to full 2009 MSA spec, and yes the front bar was illegal.

I (as you suggested) cut the front bar off, just infront of the pedal mounts, leaving the pedals in place, and welded new bar mounts onto the chassis (as per the regs) - i bought the new front bar first for allignment.

ive not yet had it officially scrutineered, but evenrone who has seen it says it should pass no probs.

If you want any photos etc just let me know

(oh and dont forget the side-mounts!!)
